By accessing and using the Kind Freedom Australia website (kindfreedom.com.au), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our website or services.
2. About Our Services
Kind Freedom Australia is an unregistered NDIS support provider operating in Melbourne, Victoria. We provide disability support services exclusively to:
- Self-managed NDIS participants
- Plan-managed NDIS participants
We do not provide services to NDIA-managed participants. As an unregistered provider, we operate in full compliance with the NDIS Code of Conduct and all applicable Australian laws.
3. Use of Website
You agree to use this website only for lawful purposes and in a way that does not infringe the rights of others or restrict their use of the website. You must not:
- Submit false, misleading, or fraudulent information through any form on our website
- Attempt to gain unauthorised access to any part of our website or systems
- Use automated tools to scrape, index, or extract content without permission
- Transmit any material that is defamatory, offensive, or in breach of any law
- Interfere with the proper working of the website or its infrastructure
4. Inquiries and Quotations
When you submit an inquiry through our website:
- You consent to us collecting and processing the personal information you provide, in accordance with our Privacy Policy
- We will respond to your inquiry within 24 business hours
- Any quotation provided is an estimate based on the information available and is valid for 30 days unless otherwise stated
- A quotation does not constitute a binding service agreement until both parties have signed a formal Service Agreement
5. Service Agreements
All disability support services are governed by a written Service Agreement between you and Kind Freedom Australia. The Service Agreement will include:
- The specific services to be provided
- The agreed pricing (aligned with NDIS Price Guide rates)
- Start and end dates, cancellation terms, and notice periods
- Your rights and responsibilities as a participant
- Our obligations under the NDIS Code of Conduct
Either party may terminate a Service Agreement with reasonable written notice as specified in the agreement.
6. Pricing and Payment
Our services are priced in accordance with the current NDIS Price Guide and Support Catalogue (2025–26). Key terms:
- All prices are in Australian dollars and inclusive of GST where applicable
- Rates may differ for weekday, Saturday, Sunday, and public holiday shifts
- We may also provide services under the Transport Accident Commission (TAC) scheme at applicable rates
- Payment is due within 14 days of invoice unless otherwise agreed
- Cancellations with less than 48 hours' notice may incur a cancellation fee in accordance with NDIS guidelines
7. Intellectual Property
All content on this website — including text, images, logos, graphics, and code — is the property of Kind Freedom Australia or its licensors and is protected by Australian copyright and intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without prior written consent.
8. Limitation of Liability
To the fullest extent permitted by Australian law:
- The information on this website is provided for general purposes and does not constitute medical, legal, or professional advice
- We make no warranties regarding the accuracy, completeness, or reliability of website content
- Kind Freedom Australia is not liable for any indirect, incidental, or consequential damages arising from the use of our website
- Our total liability for any claim is limited to the amount paid for the specific service giving rise to the claim
Nothing in these terms excludes or limits liability that cannot be excluded under Australian Consumer Law.
9. Complaints and Disputes
